Terms
1. Using BruceyBonus
1.1 Your use of BruceyBonus (the "Website") and any products, software and services provided to you on or from the Website by BruceyBonus (collectively called the "Services" in this document) is subject to the terms of a legal agreement between you and BruceyBonus. "BruceyBonus" means www.BruceyBonus.com.
1.2 Your legal agreement with BruceyBonus is made up of the terms and conditions set out in this document
1.3 The Terms form a legally binding agreement between you and BruceyBonus in relation to your use of the Services. It is important that you take the time to read them carefully.
2. Accepting the Terms
2.1 In order to use the Services, you must firstly agree to the Terms.
2.2 You may not use the Services and may not accept the Terms if (a) you are not of legal age to view alcoholic drinks, or (b) you are an individual who is legally prohibited from receiving or using the Services under the laws of the country in which you are resident or from which you access or use the Services.
2.3 You should print off or save a copy of the Terms for your records.
2.4 BruceyBonus may make changes to the Terms as and when needed
3. Your BruceyBonus account
3.1 In order to access some features of the Website or other Services, you will have to create a BruceyBonus account. When creating your account, you must provide accurate and complete information. It is important that you must keep your account password secure and confidential.
3.2 You must notify BruceyBonus immediately of any breach of security or unauthorised use of your account that you become aware of.
3.3 You agree that you will be solely responsible (to BruceyBonus, and to others) for all activity that occurs under your BruceyBonus account.
4. General restrictions on use
4.1 BruceyBonus hereby grants you permission to access and use the Website and the Services, subject to the following conditions, and you agree that your failure to adhere to any of these conditions shall constitute a breach of these Terms on your part:
- You agree not to (or attempt to) disable or otherwise interfere with any security related features of the Website or features that (i) prevent or restrict use or copying of any User Submissions or BruceyBonus Content or (ii) enforce limitations on use of the Website or the content accessible on the Website;
- If you use the ‘BB app’ on your website, you must include a prominent link back to the Website on the pages containing the BB app and you may not modify the BB app in any way;
- You agree not to use or launch any automated system (including, without limitation, any robot, spider or offline reader) that accesses the Website in a manner that sends more request messages to the BruceyBonus servers in a given period of time than a human can reasonably produce in the same period by using a publicly available, standard (i.e. not modified) web browser;
- You agree not to collect or harvest any personal data of any user of the Website or any Service (and agree that this shall be deemed to include BruceyBonus account names);
- You agree not to access User’s Business Pages (as defined below) for any reason other than your personal, non-commercial use solely as intended through and permitted by the normal functionality of the Services.
4.2 BruceyBonus grants public search engines permission to use spiders to copy materials from our site to their search site. BruceyBonus reserves the right to revoke these exceptions.
4.3 BruceyBonus aims to provide the best possible experience for its users. You acknowledge and agree that the form and nature of the Services which BruceyBonus provides may change from time to time without prior notice to you.
4.4 You acknowledge and agree that BruceyBonus may stop (permanently or temporarily) providing the Services to you or to users generally at BruceyBonus’ sole discretion, without prior notice to you.
4.5 You agree that you are solely responsible for any breach of your obligations under the Terms outlined.
5. Copyright policy
5.1 BruceyBonus operates a clear copyright policy in relation to any User Submissions which are alleged to infringe the copyright of a third party.
5.2 As part of BruceyBonus’ copyright policy, BruceyBonus will terminate user access to the Website if a user has been determined to violate copyright more than twice.
6. Your User Submissions
6.1 As a BruceyBonus account holder you may submit business pages ("User Submissions"). You understand that whether or not such User Submissions are published, BruceyBonus does not guarantee any confidentiality with respect to any User Submissions.
6.2 You retain all of your ownership rights in your User Submissions, but you are required to grant limited license rights to BruceyBonus.
6.3 You understand and agree that you are solely responsible for your own User Submissions and the consequences of posting or publishing them. BruceyBonus does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and BruceyBonus expressly disclaims any and all liability in connection with User Submissions.
6.4 You declare that you have (and will continue to have during your use of the Services) all necessary licenses, rights, copyrights, consents, and permissions for content User Submission that you upload onto BruceyBonus
6.5 You agree that you will not post or upload any User Submissions which contain content which is offensive or of a sexual nature. BruceyBonus may remove such User Submissions and terminate a User's access for uploading any User Submission which is in violation of these Terms at any time, without prior notice and at its sole discretion.
6.6 You further understand and acknowledge that in using the Website and the Services, you may be exposed to User Submissions that are factually inaccurate, offensive, indecent, or otherwise objectionable to you. You agree to waive any legal or equitable rights or remedies you have or may have against BruceyBonus with respect to any such User Submissions.
6.7 We have caped users to uploading 10 deals in one month to save duplicate offers and businesses get an advantage.
7. Rights you licence
7.1 When you upload or post a User Submission to BruceyBonus, you grant:
To BruceyBonus, a worldwide, non-exclusive, royalty-free, transferable licence (with right to sub-licence) to use, reproduce, distribute, prepare and display that User Submission in connection with the provision of the Services and otherwise in connection with the provision of the Website and BruceyBonus’ business, including without limitation for promoting and redistributing part or all of the Website (and derivative works thereof) in any media formats and through any media channels;
To each user of the Website, a worldwide, non-exclusive, royalty-free, licence to access your User Submissions through the Website, and to use, reproduce, distribute, prepare derivative works of, display and perform such User Submissions to the extent permitted by the functionality of the Website and under these Terms.
7.2 The above licenses granted by you in User Submissions terminate when you remove or delete your User Submission from the Website. The above licenses granted by you are perpetual and irrevocable, but are otherwise without prejudice to your ownerships rights, which are retained by you as set out in paragraph 6.2 above.
8. BruceyBonus content on the Website
8.1 With the exception of User Submissions, all other content on the Website including, without limitation, the text, software, scripts, graphics, photos, sounds, music, videos and interactive features on the Website (the "BruceyBonus Content") is either owned by or licensed to BruceyBonus, and is subject to copyright, trade mark rights, and other intellectual property rights of BruceyBonus. Any third party trade or service marks present on the BruceyBonus website are trade or service marks of their respective owners.
8.2 BruceyBonus Content may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purpose whatsoever without the prior written consent of BruceyBonus. BruceyBonus reserves all rights not expressly granted in and to the BruceyBonus Content.
9. Links from BruceyBonus
9.1 The Services may include hyperlinks to other web sites that are not owned or controlled by BruceyBonus. BruceyBonus has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites.
9.2 You acknowledge and agree that BruceyBonus is not liable for any loss or damage which may be incurred by you as a result of external sites or resources and is not responsible for the availability of any such websites. BruceyBonus does not endorse any advertising, products or other materials on or available from such web sites or resources.
9.3 BruceyBonus encourages you to be aware when you leave the BruceyBonus website and to read the terms and conditions and privacy policy of each other website that you visit.
10. Ending your relationship with BruceyBonus
10.1 The Terms will continue to apply until terminated by either you or BruceyBonus as set out below.
10.2 If you want to terminate your legal agreement with BruceyBonus, you may do so by closing your BruceyBonus account. Any monies paid to BruceyBonus will not be reimbursed.
10.3 BruceyBonus may at any time, terminate its legal agreement with you if you have breached any provision of the Terms (or have acted in manner which clearly shows that you do not intend to, or are unable to comply with the provisions of the Terms); or if you do not pay the correct fees for your User Submission content.
11. Exclusion of Warranties
11.1 Nothing in the Terms shall affect any statutory rights which you are always entitled to as a consumer and that you cannot contractually agree to alter or waive.
11.2 The Services are provided "as is" and BruceyBonus makes no warranty or representation to you with respect to them. In particular BruceyBonus does not represent or warrant to you that:
- your use of the Services will meet your requirements,
- your use of the Services will be uninterrupted, timely, secure or free from error,
- any information obtained by you as a result of your use of the Services will be accurate or reliable, and that defects in the operation or functionality of any software provided to you as part of the Services will be corrected.
12. Limitation of Liability
12.1 Nothing in these Terms shall exclude or limit BruceyBonus’ liability for losses which may not be lawfully excluded or limited by applicable law.
12.2 Subject to the overall provision in paragraph 11.1 above BruceyBonus shall not be liable to you for:
- any indirect or consequential losses which may be incurred by you. This shall include any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation, or any loss of data suffered by you;
- any loss or damage which may be incurred by you as a result of:
- any reliance placed by you on the completeness, accuracy or existence of any advertising, or as a result of any relationship or transaction between you and any advertiser or sponsor whose advertising appears on the Services;
- any changes which BruceyBonus may make to the Services, or for any permanent or temporary cessation in the provision of the Services (or any features within the Services);
- the deletion of, corruption of, or failure to store, any User Submissions and other communications data maintained or transmitted by or through your use of the Services;
- your failure to provide BruceyBonus with accurate account information;
- your failure to keep your password or BruceyBonus account details secure and confidential.
13. General legal terms
13.1 The Terms constitute the whole legal agreement between you and BruceyBonus and govern your use of the Services and completely replace any prior agreements between you and BruceyBonus in relation to the Services.
13.2 You agree that BruceyBonus may provide you with notices, including those regarding changes to the Terms, by postings on the BruceyBonus website.
13.3 You agree that if BruceyBonus does not exercise or enforce any legal right or remedy which is contained in the Terms (or which BruceyBonus has the benefit of under any applicable law), this will not be taken to be a formal waiver of BruceyBonus’ rights and that those rights or remedies will still be available to BruceyBonus.
13.4 If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these Terms is invalid, then that provision will be removed from the Terms without affecting the rest of the Terms. The remaining provisions of the Terms will continue to be valid and enforceable.
13.5 The Terms, and your relationship with BruceyBonus under the Terms, shall be governed by English law. You and BruceyBonus agree to submit to the exclusive jurisdiction of the courts of England to resolve any legal matter arising from the Terms. Notwithstanding this, you agree that BruceyBonus shall still be allowed to apply for injunctive remedies (or other equivalent types of urgent legal remedy) in any jurisdiction.
